(hereinafter referred to as 'Black Swan Fragrance' or “we”, “us”, “our”) These Terms and Conditions (“Terms”) apply to all purchases and use of our products and services via our webshop and other sales channels. Please read them carefully before placing an order.

2. Product Information

    products.
  • Colors may slightly vary due to monitor settings.
  • Due to the high concentration of natural ingredients in our fragrances, subtle variations may occur between batches. These slight differences are a natural reflection of the quality and authenticity of our products and do not affect their luxurious character or performance.
  • All prices include applicable VAT.

3. Ordering and Acceptance

  • Orders placed on the online boutique www.blackswan-fragrance.com are subject to acceptance. We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to cases of suspected fraud, unavailability of products, or breaches of our Terms and Conditions.
  • In the event we cancel your order, you will be promptly notified, and any payments
    made will be fully refunded without undue delay.
  • Cancellation or refusal of an order is at the exclusive discretion of Black Swan Fragrance and does not entitle the customer to any compensation beyond the refund of the payment made.
  • Once accepted, you will receive a confirmation email and your order will be processed accordingly.

4. Payment

  • Payments can be made using the methods listed on our website at the time of purchase.
  • Payment is due immediately at the time of order unless otherwise specified.
  • We implement secure payment procedures to protect your data.

5. Shipping and Delivery

  • Delivery times are estimates and may vary.
  • Shipping costs and options are displayed during checkout.
  • Risk passes to you upon delivery.
  • Please inspect your order upon receipt and report any issues within 48 hours.

6. Right of Withdrawal (Returns)

  • You have the right to withdraw from your purchase within 14 calendar days without giving any reason.
  • The withdrawal period starts from the day you or a third party indicated by you takes physical possession of the product.
  • To exercise your right of withdrawal, notify us via our contact details and return the product in its original condition and packaging. Return costs are borne by you unless otherwise stated.
  • We will refund your payment within 14 days of receiving the returned product.

7. Complaints and Warranty

  • We aim for the highest quality. If you have a complaint, please contact us promptly.
  • Warranty claims are handled according to Dutch consumer law.
  • Defective products may be repaired or replaced, or a refund issued.

11. Subscriptions and Loyalty Programs

The Founders Series

  • The Founders Series consists of five exclusive fragrances: The Founders Edition (currently available) and four forthcoming parfums.
  • By buying the Founder Series you become a Founding Member. All the releases will have the same number, one of thousand.
  • Orders will be processed on a first-come, first-served basis, subject to availability.
  • Pre-orders for unreleased fragrances will be offered exclusively to subscribers and members of The Blacklist.
  • Black Swan Fragrance reserves the right to cancel any planned release within The Founders Series. In the event of cancellation, customers who have pre-ordered the affected product(s) will receive a full refund for the cancelled and undelivered items only. Any parts of the series already received remain the property of the customer and are not subject to refund.
  • Terms for these products, including payment, shipping, and returns, adhere to the general Terms detailed herein.
  • Availability and release dates may vary and will be communicated accordingly.

12. International Sales

  • Black Swan Fragrance B.V. ships products internationally according to the shipping options provided at checkout.
  • Customers are responsible for any import duties, taxes, or customs fees applied by their country.
  • We advise customers to check their country’s import regulations before ordering.
  • Delivery times for international shipments may be longer than domestic.
  • Risk passes to you upon delivery.
  • Right of withdrawal and warranty claims apply as per EU law; however, local regulations may affect specific rights and handling.
